top batten keeps moving to wrong side when sailing in one direction, not tacking/ gybing. could it be too loose? are they adjustable?

Could be a host of different causes. Batten material/thickness incorrect.... Too much Kicker or Downhaul "loading" up the Batten... Angle of the Batten pocket too aggressive[steep] making it difficult to flick over... Top Battens are usually adjustable either by Batten String or Screw adjusters, try slackening the tension off a little first. Batten should be fully into the Pocket[check the Bottom Pocket protectors that the Batten can be fully positioned]and with neutral tension[ none]. Some may need some tension to help but you are looking for a good sail shape up there so spend some time getting the shape right then worry about getting it to move over later.
This sort of comment is certainly common and is best overcome by optimising the best setting etc from the above and then improving your own tacking/gybing style to give the Sail a "flick". You will see all Moth Helms doing this in light airs especially. Hope the above helps. If things dont improve let me know what Batten you are using...Batten Material,Thickness with a pic of the Sail with the Batten in and I will try to help. I have some other Battens you could try.

I have a problem with the top batten inverting (bending the wrong way) upwind in strong winds. I stop this by pulling more kicker on and so I assume, on 817, it is because of the very stiff (M7) mast not flattening the sail enough.
I have started loosening my top batten a little (takes some shape out) in 15knt+ winds as it makes the boat much easier to handle upwind.
